   WBI Energy Transmission, Inc. has filed a Motion for Summary Judgment in the condemnation pursuant to the federal Natural Gas Act, 15 U.S.C. §§ 717-717z, and Federal Rule of Civil Procedure 71.1 to acquire easements under those properties for the subsurface storage of natural gas in the Cedar Creek (Baker) Storage Field. The subsurface easements are located in the Judith River Subterranean Geological Formation, which is usually encountered from the surface of the earth to a depth of 1,300 feet below the surface.
