Robert L. Berndt of Baker appeared before District Judge George W. Huss on October 6, 2015, for sentencing on two misdemeanor counts of obscenity.
The charges stem from an incident alleged to have occurred at his residence in March 2013. Berndt was initially charged in Baker City Court with indecent exposure. A sentence imposed by the city court was stayed pending appeal to district court and trial de novo. At the arraignment hearing in district court, Berndt pleaded not guilty to both counts.
A plea agreement between the prosecutor and defendant was accepted by Judge Huss on September 9, 2015, after Berndt pleaded guilty to two amended misdemeanor charges of obscenity.
Berndt was sentenced to a term of six months in the Fallon County Jail, all suspended, each count to run concurrently. Berndt must also pay a fine of $1000 plus mandatory misdemeanor surcharges of $85 on each count. He was ordered to comply with all terms and conditions of this plea agreement with the city
